關(guān)于外國(guó)專利代理機(jī)構(gòu)在京設(shè)立常駐代表機(jī)構(gòu)的政策推介函（Letter of Policy Introduction for Foreign Patent Agency to Set-up Permanent Representative Office in Beijing）

各外國(guó)專利代理機(jī)構(gòu)：

為進(jìn)一步推進(jìn)我市知識(shí)產(chǎn)權(quán)服務(wù)業(yè)領(lǐng)域擴(kuò)大對(duì)外開(kāi)放，引入國(guó)際高水平知識(shí)產(chǎn)權(quán)服務(wù)資源，國(guó)家知識(shí)產(chǎn)權(quán)局批復(fù)同意在北京開(kāi)展專利代理對(duì)外開(kāi)放試點(diǎn)工作，允許外國(guó)專利代理機(jī)構(gòu)在華設(shè)立常駐代表機(jī)構(gòu)。現(xiàn)將有關(guān)政策函告如下：

一、外國(guó)專利代理機(jī)構(gòu)申請(qǐng)?jiān)O(shè)立常駐代表機(jī)構(gòu)、派駐代表，應(yīng)當(dāng)具備以下條件：

(一)該外國(guó)專利代理機(jī)構(gòu)已在其本國(guó)合法執(zhí)業(yè)，并且沒(méi)有因執(zhí)業(yè)行為受過(guò)自律懲戒或者行政處罰;

(二)代表機(jī)構(gòu)的首席代表、代表應(yīng)當(dāng)具有專利代理資格，并且已在中國(guó)境外專利代理執(zhí)業(yè)不少于2年，沒(méi)有因執(zhí)業(yè)行為受過(guò)自律懲戒或者行政處罰;

(三)該外國(guó)專利代理機(jī)構(gòu)已在其本國(guó)有10名以上專利代理師執(zhí)業(yè)。

二、外國(guó)專利代理機(jī)構(gòu)申請(qǐng)?jiān)O(shè)立的常駐代表機(jī)構(gòu)、派駐代表可以依法從事下列業(yè)務(wù)活動(dòng)：

(一)向當(dāng)事人提供該外國(guó)專利代理機(jī)構(gòu)已獲準(zhǔn)從事專利代理業(yè)務(wù)國(guó)家或者地區(qū)的專利事務(wù)咨詢;

(二)接受當(dāng)事人或者中國(guó)專利代理機(jī)構(gòu)的委托，辦理在該外國(guó)專利代理機(jī)構(gòu)已獲準(zhǔn)從事專利代理業(yè)務(wù)國(guó)家或者地區(qū)的專利事務(wù);

(三)知識(shí)產(chǎn)權(quán)培訓(xùn)服務(wù);

(四)知識(shí)產(chǎn)權(quán)許可、轉(zhuǎn)讓服務(wù);

(五)接受當(dāng)事人或者中國(guó)專利代理機(jī)構(gòu)的委托，為我市企業(yè)海外投資、海外預(yù)警、海外維權(quán)等活動(dòng)提供專業(yè)化服務(wù);

(六)代表外國(guó)當(dāng)事人，委托中國(guó)專利代理機(jī)構(gòu)辦理中國(guó)專利事務(wù)。

代表機(jī)構(gòu)及其代表應(yīng)當(dāng)依法開(kāi)展業(yè)務(wù)活動(dòng)，不得從事代理專利申請(qǐng)和宣告專利權(quán)無(wú)效等中國(guó)專利事務(wù)以及中國(guó)法律事務(wù)。

三、外國(guó)專利代理機(jī)構(gòu)在華設(shè)立常駐代表機(jī)構(gòu)，應(yīng)當(dāng)在企業(yè)登記管理部門辦理登記手續(xù)，并經(jīng)國(guó)家知識(shí)產(chǎn)權(quán)局批準(zhǔn)，提交的文件材料包括：

(一)該外國(guó)專利代理機(jī)構(gòu)主要負(fù)責(zé)人簽署的設(shè)立常駐代表機(jī)構(gòu)的申請(qǐng)書;

(二)該外國(guó)專利代理機(jī)構(gòu)給代表機(jī)構(gòu)擬任首席代表、代表的授權(quán)書，該授權(quán)書中應(yīng)當(dāng)明確代表機(jī)構(gòu)、代表的業(yè)務(wù)范圍;

(三)國(guó)家知識(shí)產(chǎn)權(quán)局要求提交的其他材料。

Letter of Policy Introduction for Foreign Patent Agency to Set-up Permanent Representative Office in Beijing

Foreign Patent Agencies:

In order to promote the opening up of the intellectual property service industry and attract high-level international intellectual property service resources in Beijing, China National Intellectual Property Administration(CNIPA) approved the pilot work of patent agency opening to the world in Beijing, allowing foreign patent agency to set up permanent representative office in China. The policy is as follows:

1. The foreign patent agency who apply for the setting-up of a permanent representative office or sent representatives, shall meet the following conditions:

1) The foreign patent agency has already legally practiced in its own country and has not discipline punishment or administrative punishment record;

2) The chief representative or representatives of the representative office shall have the patent agency qualification, and have practiced patent agency outside China for not less than 2 years, and have not discipline punishment or administrative punishment record;

3) The foreign patent agency has more than 10 patent attorneys practicing in its own country.

2. The permanent representative office and representatives set up by foreign patent agency can abide by the law to do the following business:

1) To provide patent consultant business which the foreign agency was permitted to do in the country or region;

2) To accept the authorization of the people or the Chinese patent agency, to provide the patent agency business which the foreign patent agency was permitted to do in the country or region;

3) IP training service;

4) IP licensing and transferring service;

5) To accept the commission of the people and the patent agency of China, to provide professional services for the overseas investment, early warning, rights protection and other activities for the enterprises in Beijing;

6) To on behalf of foreign parties, entrust Chinese patent agency to solve Chinese patent affairs.

The representative office and representatives shall legally operate business, and shall not be engaged in China's patent affairs and China's legal affairs, such as agent patent application and invalidation of patent right.

3. To establish a permanent representative office in China, the foreign patent agency shall register in the administration department for enterprise registration, and obtain the approval of the China National Intellectual Property Administration(CNIPA). The submitted documents include:

1) The application for the setting up of permanent representative office signed by the person-in-charge of the foreign patent agency;

2) The letter of authorization proposed by the foreign patent agency to be the chief representative or representatives of the representative office shall specify the business scope of the representative office or representatives;

3) Other documents required by the China National Intellectual Property Administration(CNIPA).
